We offer two types, basic and extended – so you can choose the endorsement that’s right for your business.

Lost Wages and Medical Care

Provides injured workers with compensation for lost wages as well as the reasonable cost for necessary medical care and rehabilitation services related to a workers' compensation.

Business Travel Protection

Most workers' compensation policies only provide coverage for the states in which you do business. However, The Hartford's policy extends its workers' compensation coverage to employees who travel on business to other states and in some instances other countries.  If your employees travel on business outside the United States on a regular basis, additional coverage can be obtained to extend your workers' compensation insurance to cover these situations.

Employer's Liability

To recover benefits under your state's workers' compensation law, your employees don't have to prove you were responsible for their employment-related accident or injuries. If they can prove you were liable, they may be able to successfully sue your business to recover damages beyond the workers' compensation benefits. You'll be comforted to know that the employer's liability portion of The Hartford's workers' compensation policy can pay for the damages awarded to your injured employee as well as the legal expenses involved in such a suit. This coverage may also provide certain benefits if you are sued by a third party affected by a workplace injury, such as a family member of the injured worker.

Employer's Liability in Monopolistic States

Some state governments mandate that employers purchase workers' compensation insurance from the state fund. If one of your employees is injured in one of these states and decides to file a workers' compensation claim, coverage is provided by the state fund. As a customer of The Hartford we automatically provide "employer's liability" coverage in monopolistic states to pay for related expenses and damages in the event you’re sued. Other insurers may offer this extended coverage in these states, but only if you specifically request that it be added to your policy.

Legal Expenses

If your business is covered by our workers' compensation policy, The Hartford will pay legal expenses related to a workers' compensation or employer's liability claim. The Hartford will work closely with you in investigating; defending and settling related claims, proceedings and law suits. When appropriate, we will retain an attorney to represent you in such a suit. The Hartford will: pay the cost of defending you in hearings, suits, etc, that result from occurrences covered by workers' compensation; and pay the damages awarded if you are successfully sued because of a job-related injury or disease. 

Third-Party Suits

If your employee is injured in an accident, that employee may try to sue a "third party" (a company other than yours) if they believe that party is somehow responsible for their injury   that third party may sue you if it believes your company is legally liable for the accident. For example, an employee injured while using a piece of equipment may sue the equipment manufacturer for some alleged negligence or faulty design. However, the manufacturer can then turn around and sue your company if they believe the accident was instead caused by your improper maintenance of the equipment. In this situation, the Employer's Liability coverage of your policy is designed to pay any damages awarded by the court to compensate for the bodily injury.

Employers liability coverage pays for other damages the employer may be found legally responsible for due to an employee's injury. These may include wrongful death, damages for care or loss of services, consequential injury to a spouse, child, etc. These would result from a lawsuit filed by the employee or a third party. Because workers' compensation is designed to be a "no-fault" type of coverage, it is usually very difficult for an employer to be found liable for these consequential damages. Generally, the employer would have to intentionally injured an employee or have forced the employee to perform a certain task that would almost certainly injure the employee.
