Heavy Decision: Is Obesity a Disability?

Obesity is a serious health problem. But is it a disability?

Ruling morbid obesity as a physical impairment, protected by the Americans with Disabilities Act (ADA), is an action that some courts could decide to take.

But although the ADA doesn't exclude obesity from its list of disabling conditions, simply being overweight isn't enough to qualify. And some courts may stipulate that obesity must be caused by a serious physiological problem, not by overeating, to be categorized as a disability.

1This statistic was calculated by information derived from the Department of Labor website by the Disability Management Employer Coalition. The data for the "Full Time U.S. Private Sector Employee Population" and the "Average time lost" was derived from Table 47: located at http://www.bls.gov/cps/cpsa2010.pdf and the data for the "Employer cost of employee lost time" is located at http://www.bls.gov/news.release/pdf/ecec.pdf as of March 2011. The statistic is calculated by multiplying the "Employer cost of employee lost time" by the "Full Time U.S. Private Sector Employee Population" by the number of hours an employee works per year divided by the average amount of time lost due to illness/injury/other reasons.
