Required Liability Insurance Coverages in New York

The following minimum liability car insurance limits are required by New York state law:2
 
  • $25,000 for bodily injury, per person per accident
  • $50,000 for bodily injury, total per accident
  • $10,000 for property damage per accident

Proof of Car Insurance in New York

It’s a good idea to keep a hard copy of your car insurance ID cards and your registration in your car at all times, should the unexpected happen. In New York, drivers can also provide electronic proof of car insurance. The Hartford offers a mobile app that gives you the flexibility to store your car insurance ID cards on your mobile device so that they are always with you. New York Uninsured Driver Facts

According to a 2012 Insurance Research Council report, 5.3% of New York drivers are uninsured. This is well below the national average of 12.6%.3
 
Being involved in an accident with an uninsured or underinsured motorist could be financially devastating. That’s why New York state law requires drivers to carry uninsured/underinsured motorist car insurance coverage. In New York, your uninsured/underinsured motorist car insurance coverage must have the minimum coverage amounts of2:
 
  • $25,000 per person
  • $50,000 per accident

Staying Safe on New York Roads

As you travel through New York, there are a number of safe driving laws meant to protect you on New York’s highways and byways. Here are just a few:4
 

New York Seat Belt Laws:

New York is one of 34 states that have a primary seat belt law – which means that law enforcement can ticket a driver or passenger for not wearing a seat belt without any other traffic violation.
 

New York Distracted Driving Laws:

New York has a number of laws in place to discourage distracted driving:
 
  • The use of hand-held cell phones by New York drivers is prohibited by law in New York.
  • Texting while driving is banned in the State of New York.

New York Teen Driver Laws:

Getting a driver’s license is a rite of passage for all teenagers, and New York wants to be sure they stay safe in the process! New York has implemented graduated licensing laws to ensure that teenagers gain the experience and maturity that’s required to be safe behind the wheel. Graduated licensing laws limit nighttime driving, restrict teen passengers and ensure an adequate amount of supervised driving practice.

If you are age 50 or older, once you're insured through this Program for at least 60 days, you cannot be refused renewal as long as applicable premiums are paid when due. Also, you and other customary drivers of your vehicles must retain valid licenses, remain physically and mentally capable of operating an automobile, have no convictions for driving while intoxicated and must not have obtained your policy through material misrepresentation. Benefit currently not available in HI, MI, NH, NC and TX.
 
§§ Limitations apply.
 
First Accident Forgiveness and the Disappearing Deductible, are only available with the Advantage Plus package. A policy without these benefits is also available. (Call for details.) To qualify for the Accident Forgiveness benefit in most states, all drivers on the policy must have a clean driving record (no accidents or violations) for five consecutive years. First Accident Forgiveness is not available to CA policyholders. To qualify for the Disappearing Collision Deductible benefit in most states, all drivers on the policy must have a clean driving record for three consecutive years. NY drivers are not eligible for the complete disappearance of the deductible, although it will be reduced to a minimum of $100. The Advantage Plus package option, the Disappearing Deductible benefit and the Accident Forgiveness benefit are not available in all states.
 
‡‡ One Deductible applies for any Home policy (Home Advantage or not) if Auto policy is also insured with The Hartford and includes the Advantage Plus package coverage.
