TrueLane® Mobile Application Program Terms and Conditions

These TrueLane® Mobile Application Program terms and conditions (“Agreement”) apply to your voluntary participation in The Hartford’s (Hartford Fire Insurance Company and its affiliated property casualty insurers hereinafter “The Hartford”, “Hartford”, or “we”) TrueLane® Mobile Application Insurance Program. This Agreement is between you and The Hartford. The Agreement applies to the Program and The Hartford’s use and collection of information, data and “Collected Data”. You must execute this Agreement in order to enroll and participate in the Program. The App used in the Program is a telematics data collection device provided by Cambridge Mobile Telematics Inc. (“CMT”) (“the App”). For more information about CMT, please visit their website https://www.cmtelematics.com/
 

1. Eligibility

To be eligible to participate in the Program you must: 
  • Have an active auto insurance policy from The Hartford (“Participating Policy”);
  • Have access to an automobile, pick-up, or van, insured under a Hartford Auto policy;
  • Be a licensed driver listed on a Hartford Auto policy;
  • Agree to receive text (SMS) messages on your smartphone about your policy and participation in the TrueLane Program at all times while participating in the program https://www.thehartford.com/truelane2-texting-terms-conditions
  • Install and update the App on a smartphone with sufficient cellular coverage, permission services, sensors, and data plan able to collect and transfer the Collected Data;
  • Accept these Terms and Conditions after receiving the welcome text (SMS message);
  • Have a valid and continuously active email address and smartphone number;
  • Take your first drive to begin collecting data within 30 days of your enrollment effective date;
  • Tag each trip after completion if you were other than the driver; and
  • Activate the App and maintain connectivity each time you operate a motor vehicle.

2. Program Pricing

Please note that the TrueLane Program will only be applied to one Participating Policy. Less than full participation by all eligible drivers may result in a lower UBI score and higher corresponding premium.
 

A. Initial Term

 Your Participating Policy may benefit from a participation discount for the first policy term (“Participation Discount”). Please be advised that the Participation Discount will be immediately removed if the eligibility criteria are not met, or if you withdraw from the Program. Your Participation Discount may be removed and your individual participation in the Program terminated if we do not collect your driving data for a number of consecutive days, if the total time the App was connected to a smartphone during a policy term is insufficient for The Hartford to determine your driving behavior, or if the pattern of App disconnections suggests the reported driving behavior is not representative of actual behavior. Each eligible and participating driver must be separately enrolled in the Program and must complete a separate Terms and Conditions agreement. If there are no eligible drivers on a Participating Policy or if all drivers on the Participating Policy have been terminated or removed from the Program, the Participating Policy will be removed from the Program.
 
The Participation Discount will be applied to eligible drivers if enrollment in the Telematics Program occurs at new business policy issuance or within 60 days from the new business policy effective date. The Participation Discount will apply for the initial policy term, or until a UBI score is established if a UBI score is not yet available upon renewal. If the participating driver does not activate the App within 30 days from the new business effective date, the Participation Discount will be removed and the driver will be unenrolled from the Program. Unenrollment from the Program for any reason will result in the immediate removal of the Participation Discount.
 

B. Renewal Terms

When your Participating Policy renews, the data collected by the App for all participating Program drivers during the prior policy term will be used to develop a UBI Score to determine whether the Participating Policy will be subject to a renewal discount (“Renewal Discount”) or a renewal surcharge (“Renewal Surcharge”). The Renewal Discount or Renewal Surcharge (“Program Pricing”) does not apply to all vehicle coverages. Program Pricing does not guarantee a change in total policy premium as other rating factors unrelated to the program may apply.
 
Program Pricing will change at each Participating Policy renewal based on the continuing driving behavior of all Program drivers based on the Collected Data.
 
Please note the following as it relates to the Program Pricing:
 
  • Program Pricing is based on Collected Data.
  • The App must collect data from you for at least 91 days. If you do not meet this minimum requirement prior to the first renewal of your Participating Policy, your driving data will not be included in the UBI Score calculation. Program Pricing may be removed and participation in the Program terminated if the total time the App was connected to a smartphone during a single policy term was insufficient for The Hartford to make a reasonable determination of your driving behavior.
  • If a participating driver is unenrolled in the Program at any point after establishing a UBI Score, a non-monitoring factor will be assigned at the next renewal based on the last recorded UBI score used to determine Program Pricing, which could result in a discount or surcharge. If the participating driver is unenrolled after the first 45 days of Program participation without establishing a UBI Score, an unenrollment factor will be assigned at the next renewal which will persist for all policy renewals until the otherwise eligible driver reenrolls in the Program.

3. Enrollment

You will receive a welcome text (SMS) message with instructions to download and log into the App. Once you log in, accept these Terms and Conditions, allow the App to access your location and mobile permissions and take your first drive, the App will be activated and begin recording Collected Data. At this point the enrollment process is complete and the App will begin sharing data regarding your trips and events.
 
Please note that if you were a passenger in a vehicle (not driving yourself), you must inform us via the App and confirm your mode of transportation within 14 days of the trip. 
 
The App must remain activated on your smartphone each time you drive any vehicle, regardless of type or use.
 

4. Safe Use of the Application

  • If you change smartphones, you must download the App to your new phone.
  • You agree to obey all traffic laws.
  • You agree to use the App only when it is safe to do so.
  • You agree that you will not use the App for any illegal, hazardous, or unauthorized purposes, or in a manner that is not consistent with these Terms and Conditions.
  • You agree to not physically activate, engage with, or interact with the App while operating a motor vehicle.

5. Ending Policy Enrollment in the Program (Termination)

If you are the Named Insured or a spouse of the Named Insured on your Participating Policy, you or The Hartford may end your enrollment in the Program at any time and for any reason. If you are a Program driver but not the Named Insured or a spouse of the Named Insured, you or The Hartford may end your own individual participation in the Program. If Program enrollment for your Participating Policy ends for any reason, Program Pricing will continue, and your Participating Policy may experience a change in pricing based on your unwillingness or failure to continue to participate in the Program and the loss of all program benefits. Upon individual or Program termination from the Program, you agree to remove the App from your smartphone. The nonrenewal or cancellation of the Participating Policy will also result in Program termination.
 

6. Services (Websites) and App Information

The Program enables you to access The Hartford and CMT services and websites and App information (“Services”). Use of these Services requires internet access and acceptance of additional terms of use, separate from these Terms and Conditions.
 
Services may contain proprietary content, information, data and material protected by applicable intellectual property and other laws. Except for permitted use of the Services, you shall not use or transfer to any third party such proprietary content, information, data or materials. You shall not reproduce any portion of the Services in any form. You agree to keep passwords secure and confidential, prevent unauthorized access to your account, and notify The Hartford promptly of any such unauthorized access. You shall not use the Services in any manner to harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other party. The Hartford is not in any way responsible for any such use by you, nor for any harassing, threatening, defamatory, offensive or illegal messages or transmissions you may receive because of using the Services.
 
The Hartford and its licensors reserve the right to change, suspend, remove, or disable access to any Services at any time without notice. In no event will The Hartford be liable for the removal of, or disabling of access to, any such Services. The Hartford may also impose limits on the use of, or access to, certain Services, without notice or liability.
 

7. Ownership and Other Users 

By participating in the Program, you represent that you are the owner of the participating smartphone and a listed and permissive operator of a vehicle insured by the Participating Policy. You consent and agree that: (i) the App will be downloaded onto your smartphone, and (ii) we will collect and use the data provided from the App, including any personally identifiable information, as set forth in Section 8, Privacy and Data Security, Data Use, and Data Ownership; (iii) The Hartford may communicate Participating Policy and Program information via email and SMS Messages; and (iv) that you obtained permission from all Program Participants to provide their smartphone numbers and email addresses to The Hartford.
 

8. Privacy, Data Security, Data Use, and Data Ownership

All Collected Data obtained by the App is willingly and voluntarily provided by you to both The Hartford and CMT. Information you provide to The Hartford is governed by this Agreement and The Hartford’s Privacy Policy, which may be accessed at https://www.thehartford.com/online-privacy-policy. Information you provide to CMT is governed by CMT’s privacy policy, which may be accessed at https://www.cmtelematics.com/privacy-policy/
 
The following terms supplement The Hartford’s Privacy Policy regarding the information and Collected Data obtained by the App and used in the Program.
 
A. Collection: The App will collect the following types of data via multiple sensors (“Collected Data”), which may be used by The Hartford for any permissible purpose:
 
  • Device information;
  • Location;
  • GPS latitude, longitude, altitude, time of position, speed, GPS accuracy, heading;
  • Trip information;
  • Score and/or discount;
  • Speeding - location, duration, severity;
  • Braking - location, duration, severity;
  • Acceleration - location, duration, severity;
  • Gyroscope, barometer, and magnetometer data;
  • Distracted driving data - phone handling, calls while driving, use of hands Free or handset. NOTE: No information is collected regarding call content or communication destination number or caller ID.
  • Driver assignment and use of alternate mode of transportation or travel as passenger. Please note: the App makes assumptions about your trips, including whether you were the driver, which you have the opportunity to correct within 14 days.
  • Application data - user credential and date/time the Application is activated,
  • Phone cellular plan data and acceptance of permissions.
Actual Information or data collected may change and vary by smartphone. The above list is not exhaustive of the information or data collected and may change during participation in the Program based on technological improvements, device capability, utility to The Hartford, and as necessary to support insurance underwriting, rating, pricing, research, claims, determination of fault/liability, and other data variables. 
 
B. Use of Collected Data: You agree, consent, and understand that The Hartford may use the Collected Data to determine Program Pricing. You also agree, consent, and understand that the Collected Data will be used to derive additional data and that, in addition, to determine Program Pricing, the Collected Data may be used by The Hartford and CMT to perform the Services, which includes research and development. Finally, you agree, consent, and understand that the Collected Data may also be used by The Hartford for any other permissible purpose, regardless of whether specifically listed in this Agreement or whether you continue to be a Hartford customer, including insurance underwriting criteria and processes, rating, pricing, research, claims, determination of fault/liability, in connection and in concert with other data variables, and that Collected Data may be shared by The Hartford with any third-party with regard to these, or any other permissible, uses now or at any time in the future. You further agree, consent, and understand that Collected Data, and all of the uses described and permitted by this Agreement, may continue regardless of whether any Participant remains in the Program or is listed on a Participating Policy, including circumstances where a Participant reenrolls in the Program or obtains a new Hartford auto policy after a lapse in coverage occasioned by coverage through a competitor or policy cancellation or non-renewal.
 
C. Ownership and Future Use of Collected Data: You agree The Hartford will own all Collected Data, and anything derived or resulting from the use of Collected Data, including but not limited to UBI Score or Program Pricing, collected during this Program, including but not limited to Collected Data generated by or derived from the App. If The Hartford is found not to own the Collected Data you hereby grant to The Hartford an irrevocable, non-exclusive, perpetual, worldwide, royalty-free, assignable right and license to use, sublicense, reproduce, maintain, modify, display, create derivative works of, and otherwise fully exploit and commercialize the Collected Data in an aggregated and not personally identifiable form. You further agree to cooperate, if necessary, with The Hartford in perfecting The Hartford’s rights in the Collected Data. You acknowledge and agree that The Hartford may analyze the Collected Data, including GPS data and Distracted Driving data, to determine ways to develop or enhance The Hartford’s insurance programs, services and/or products, including the creation of non-insurance products and services.
 
D. Use of Collected Data within Claims, Pricing, and Underwriting: You further agree the Collected Data may be used in connection with any third party insurance claim, lawsuit, legal action, judicial proceeding, arbitration, mediation, other action or threat of action, or allegation related in any way to the insurance coverage provided by your Hartford auto policy (specifically including, personal injury protection or medical payment coverage and uninsured or underinsured motorist coverage), that you make or is brought against you, including to the extent we disclose the Collected Data as described in Required Disclosures below. You further agree that the Collected Data may be used to evaluate your underwriting status and eligibility, including the determination of various pricing, rating and underwriting variables used to develop pricing and program suitability.
 
E. Sharing and Disclosures: The Hartford will share the Collected Data with subsidiaries of The Hartford or affiliated companies and third-party service providers who assist us in managing the Program and in using, processing and analyzing the Collected Data. We also may share the Collected Data in an aggregated and anonymous form with Departments of Insurance or other government agencies to support applications for new ways to rate or underwrite insurance and to support current or future products and product filings. We may share Collected Data (including personally identifiable) in connection with a complaint investigation, litigation, market conduct, regulatory review or in response to an inquiry from a government authority. The Hartford may use and authorize its service providers to use the Collected Data when it is in aggregated and anonymous form for any purpose.
 
F. Required Disclosures: We may also provide the Collected Data to a third party when, at our discretion, circumstances require disclosure. 
 

9. Program Changes

The Hartford reserves the right to modify or terminate this Agreement, the Terms and Conditions applicable to this Program, the Program and TrueLane Rewards at any time for any or no reason.
 

10. Notices

You must provide us with a valid email address and mobile smartphone number and agree to receive communications by electronic means. You may, at any time, request to withdraw your consent to receive such communications by electronic means. Your request to withdraw consent prior to completion of the evaluation period will result in the removal of your driver data from collection for the Participating Policy and will terminate your individual enrollment and discount in the Program. You may request to withdraw consent by texting STOP as a response to a text from The Hartford or by calling The Hartford at 800-300-6449. If you wish to contact us, you may contact our Call Center by clicking the "Help" link in the text we sent you, or by visiting My Account. To change your email address and mobile smartphone number, you must promptly provide us with the new information. In the event of your failure to maintain a valid email address and mobile smartphone number, or your withdrawal of consent to receive SMS messages, and any resulting inability to deliver communications to you via SMS message, we will presume you have withdrawn consent to receive communications by electronic means and will remove your enrollment in the Program.
 

11. No Warranty of Device or Services

You acknowledge and agree your participation in the Program and use of the App are at your sole risk and the entire risk as to satisfy quality, performance, accuracy and effort is with you. The App and any services performed or provided by or associated with the program are provided “as is” and “as available”, with all faults and without warranty of any kind. The Hartford hereby disclaims all warranties and conditions with respect to the Program, App and any services, either express, implied or statutory, including, but not limited to, the implied warranties and/or conditions of merchantability, of satisfactory quality, of fitness for a particular purpose, of accuracy, of quiet enjoyment, non-infringement of third party rights, that the App or services will be uninterrupted or error-free, or that defects in the App or services will be corrected.
 

12. Limitation of Liability

In consideration of the use of the App and premium benefits you may be eligible for, you agree we will not be liable for any loss or damage to you, your property (including your smartphone), or others caused by the use of the App or failure of the App to function. You agree that we will not be liable for any damages arising out of or in connection with this Agreement.
